1. Acceptance of Terms

By placing an order with SheHarmony you agree to these terms of service. If you do not agree do not use our services.

2. Service Description

SheHarmony provides AI-generated personalized songs and album artwork. All content is generated using artificial intelligence and delivered digitally. Songs may include AI-generated lyrics based on your story, and the AI may interpret or paraphrase submitted lyrics for musical phrasing and flow.

3. Photo and Content Submission

By uploading any photo or content to SheHarmony you confirm and warrant that:

• •You own the rights to the photo or have explicit permission from the person in the photo
• •The person in the photo has consented to having their likeness used to create AI-generated content
• •You will not upload photos of minors without parental consent
• •You will not upload photos of celebrities, public figures, or any person without their explicit consent
• •You will not upload copyrighted images you do not own
• •SheHarmony reserves the right to refuse any order that violates these terms
• •You accept full legal responsibility for any photos you submit

4. AI-Generated Content Notice

All content produced by SheHarmony is created using artificial intelligence. By purchasing you acknowledge:

• •Content is AI-generated and unique to your order
• •Minor variations from expectations may occur due to the nature of AI generation
• •SheHarmony does not guarantee any specific creative outcome
• •Generated content may not be used to defame, harass or harm any individual
• •Generated content may not be used for illegal purposes

5. Ownership and License

Upon successful payment:

• •You receive a personal license to use your generated content
• •You may share your content on personal social media
• •You may print your content for personal use
• •You may not resell or redistribute SheHarmony generated content as your own product
• •SheHarmony retains the right to use anonymized samples for marketing purposes unless you opt out by emailing support@sheharmony.com

6. AI-Generated Content Disclosure

All songs and album artwork provided by SheHarmony are generated using artificial intelligence. No human composers, musicians, vocalists, or artists are involved in the creation of your content.

• •Songs are generated using leading AI music generation services based on your story, preferences, and selected options
• •Album artwork is generated using AI image generation services
• •The AI may interpret, paraphrase, or adapt your submitted story and lyrics for musical phrasing, rhythm, and flow
• •Output quality is subjective — we do not guarantee any specific emotional response or creative outcome
• •Coincidental resemblance to existing works is possible and is not considered a defect
• •We make no warranty that your deliverable will be entirely original or free from resemblance to existing works, melodies, or visual styles
• •AI generation involves randomness — identical inputs may produce different outputs
• •Under current US Copyright Office guidance, AI-generated content may not be eligible for copyright registration

7. License Grant to You

Upon successful payment, SheHarmony grants you a personal, non-exclusive, non-transferable license to use your generated content. You MAY:

• •Use the content for personal, non-commercial purposes
• •Gift the content to the identified recipient
• •Share on personal social media (Instagram, TikTok, Facebook, X) as a gift or personal expression
• •Make personal copies and backups
• •Play at private events (parties, weddings, celebrations)

You may NOT:

• •Resell, sublicense, or commercially distribute the song or artwork
• •Use in paid advertising, commercial content, or monetized videos without written permission
• •Claim the song was created by a human artist or composer
• •Submit to music streaming platforms (Spotify, Apple Music, YouTube Music, SoundCloud, etc.) under your own artist name or as your own composition
• •Submit to copyright registries claiming sole human authorship
• •Use to train other AI systems
• •Use in any way that violates the Prohibited Uses section

8. Your Inputs and Our Use of Them

By placing an order, you grant SheHarmony a limited license to process your inputs through our AI services for order fulfillment. Your inputs include:

• •Names (yours, recipient's)
• •Story details and memories you share
• •Photographs (if uploaded for album artwork)
• •Style descriptions and preferences
• •Recipient information

We store your inputs for order fulfillment, customer service, dispute resolution, quality assurance, and as required by law. We may use anonymized and aggregated data for service improvement. We will NOT use your inputs in marketing materials without separate consent. We will NOT sell your inputs to third parties. You represent that you have the right to submit all inputs and that they do not infringe the rights of any third party.

9. Third-Party AI Services

To fulfill your order, your inputs are transmitted to third-party AI service providers for content generation. These providers process your data according to their own terms of service and privacy policies, which we have reviewed and determined to be consistent with industry standards.

By placing an order, you consent to this processing. SheHarmony is not responsible for third-party practices beyond our reasonable selection and oversight of these providers.

10. No Professional or Therapeutic Advice

SheHarmony products are creative entertainment products intended for personal enjoyment and gift-giving. Our services are NOT:

• •Relationship counseling or therapy
• •Psychological, emotional, or mental health advice
• •A substitute for professional help or licensed counselors
• •Medical advice of any kind

If you are experiencing relationship difficulties, emotional distress, or mental health concerns, please consult a licensed professional. A personalized song is a creative gift, not a therapeutic intervention.

11. Delivery

• •Digital products are delivered via email to the address provided at checkout
• •Delivery times vary by product as stated on our pricing page
• •SheHarmony is not responsible for emails blocked by spam filters
• •Contact support@sheharmony.com if you do not receive your delivery within the stated timeframe

12. Refund Policy

Due to the custom AI-generated nature of all products:

• •All sales are final
• •No refunds are offered once generation has begun
• •If you experience a technical failure where no content was delivered contact support@sheharmony.com within 48 hours
• •SheHarmony will make reasonable efforts to resolve delivery failures
• •Chargebacks filed without contacting support first may result in order cancellation and refusal of future service

13. Prohibited Uses

You may not use SheHarmony to create content that:

• •Depicts or implies illegal activity
• •Harasses, threatens or defames any individual
• •Contains hate speech or discriminatory content
• •Sexualizes any individual without their explicit consent
• •Impersonates any real person without their consent
• •Violates any applicable law or regulation

SheHarmony reserves the right to refuse any order at our sole discretion.

14. Privacy

• •We collect only information necessary to fulfill your order
• •We do not sell your personal information to third parties
• •Uploaded photos are used solely to generate your ordered product
• •Photos are stored securely and deleted after 30 days

15. Limitation of Liability

SheHarmony's total liability for any claim shall not exceed the amount paid for the specific order in question. SheHarmony is not liable for any indirect, incidental or consequential damages.

16. Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising from these terms or your use of SheHarmony services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Maricopa County, Arizona, or remotely at the claimant's election.

You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative action against SheHarmony.

17. Force Majeure

SheHarmony shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: AI service provider outages, natural disasters, acts of government, internet disruptions, third-party service failures, or unforeseen technical limitations. In such events, we will make reasonable efforts to resume service or provide refunds at our discretion.

18. Age Requirement

You must be at least 18 years of age to place an order with SheHarmony. By placing an order, you represent and warrant that you are 18 years of age or older. If you are placing an order on behalf of another person (as a gift), you represent that you have the authority to do so.
